Legal Disclaimer & Indemnity Agreement

By accessing, browsing, or using Yard Bean website, mobile application, or any affiliated services (“The Yard Bean,” “we,” “our,” “us”), you (“user,” “you,” or “your”) acknowledge and agree to the following terms:

1. Use at Your Own Risk

The Yard Bean provides a platform for users to list, locate, promote, and browse yard sales, garage sales, or similar local events. All interactions, transactions, communications, and exchanges that occur as a result of listings on Yard Bean are strictly between users. Yard Bean does not verify, endorse, or guarantee the accuracy, safety, legality, or condition of any listings, items, locations, or individuals involved.

You assume full responsibility for any risks associated with your use of this platform, including but not limited to financial loss, personal injury, theft, property damage, or fraudulent activity.

2. Release of Liability

To the fullest extent permitted by applicable law, you hereby release, waive, and discharge Yard Bean, its owners, founders, developers, employees, contractors, agents, affiliates, licensors, and partners (collectively, the “Released Parties”) from any and all claims, demands, causes of action, losses, liabilities, damages, or expenses—whether known or unknown, suspected or unsuspected, disclosed or undisclosed—that arise out of or relate in any way to your use of the platform.

This release applies regardless of the nature of the claim or the jurisdiction in which it may be brought, including but not limited to claims brought under the laws of any state, county, city, town, province, district, or federal jurisdiction within or outside of the United States, including all 50 U.S. states and territories.

3. Indemnification

You agree to indemnify, defend, and hold harmless Yard Bean and its Released Parties from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:

• Your      use or misuse of the platform;
   
• Your      violation of these Terms;
   
• Your      violation of any applicable laws or regulations;
   
• Any      content or data you submit or post;
   
• Any      disputes or dealings with other users, third parties, or event attendees.
   

4. No Warranty

Yard Bean is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied. We make no warranties or representations regarding the accuracy, reliability, completeness, or timeliness of the content or the services provided.

5. Limitation of Liability

IN NO EVENT SHALL YARD BEAN OR ANY RELEASED PARTY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR ACCESS TO OR USE OF THE PLATFORM.

6. Jurisdictional Compliance

This indemnity and liability waiver is intended to apply regardless of jurisdiction, including but not limited to federal, state, municipal, tribal, or international law. You agree that this document shall be interpreted to the broadest extent permitted by applicable law.

7. Severability

If any provision of this agreement is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from the rest and shall not affect the validity and enforceability of the remaining provisions.

Acknowledgment

By continuing to use Yard Bean, you acknowledge that you have read, understood, and agree to be bound by the above release of liability and indemnity agreement.
